(2) These general terms and conditions are the only ones accepted for all offers, orders, deliveries, and services, in the version valid at the time of contract conclusion. We only acknowledge customer terms that contradict or deviate from our general terms and conditions if we have expressly accepted their validity in writing.
(3) In addition to these general terms and conditions, the collection and use of personal data are also subject to our data protection declaration.
(4) If these General Terms and Conditions refer to the customer as “professional customer” and “consumer,” the term “professional customer” refers to individuals or legal entities or partnerships that have legal capacity and, when concluding a legal transaction, act in the course of their commercial or independent professional activity. Consumers are exclusively natural persons who conclude a legal transaction for purposes that are neither commercial nor related to their independent professional activity.
(5) These general terms and conditions also apply to all future transactions with the customer insofar as they relate to related legal transactions.
2. Order and Conclusion of Contract
(1) The presentation of products in the online store does not constitute an offer with any obligation but rather an online catalog with no purchase obligation. The information about each product should enable the buyer to make an informed choice.
(2) By ordering the products, the customer submits a firm offer to conclude a purchase contract for the ordered goods, to which they are bound for seven working days without refusal. Upon receipt of the order, the customer receives an automatic confirmation of their order via email to the email address provided during the ordering process. If you order using the “credit card” or “instant transfer” payment method, your order will be accepted immediately.
(3) The contract is concluded provided that we make a correct and timely delivery. This only applies if non-delivery is due to an obstacle for which we are not responsible. The professional customer will be immediately informed of the unavailability of the service. If the service has already been delivered, the counter-performance will be refunded.
(4) Storage of the Contract Text: We record the text of the contract and send you the order details by email. The terms and conditions can be viewed at any time on this page. You can view past orders in your customer account or request them by email.
3. Prices, Shipping Costs
(1) Unless expressly stated otherwise, the prices listed in our online store theluxekit.com are total prices, including shipping costs.
Shipping is free for all orders.
(2) If the customer exercises their right of withdrawal, the customer bears the shipping costs for the merchandise.
4. Payment Terms and Retention of Title
(1) For payments in our online store, the customer can use the following payment methods: instant bank transfer and credit card.
(2) If the customer chooses the “bank transfer” payment method, the customer will automatically receive a separate email after placing their order specifying the amount to be paid and our bank details. The customer agrees to transfer the corresponding amount to our business account within five working days of receiving this information. Once we have received the full amount in our account, we will process the order within two (02) working days.
(3) If the customer chooses the “credit card” payment method when placing their order, the customer must provide their credit card details. Once we have accepted the order, the payment amount will be debited from the credit card.
(5) Commercial customers are only entitled to compensation if their counterclaims are legally justified or undisputed. The customer may only exercise a right of retention to the extent that their counterclaim concerns the same contract.
(6) LUXEKIT reserves the ownership of all goods delivered to a customer until the full payment of the delivered goods has been made.
5. Delivery and Shipping Conditions, Transfer of Risk
(1) Ordered items are delivered via DHL shipping service. If the customer is a professional customer, the risk of accidental loss or damage to the goods is transferred to them as soon as the goods leave the factory/warehouses. This applies regardless of the identity of the shipper, whether the goods are shipped from the place of performance or from another location, and regardless of who bears the shipping costs.
(2) The customer guarantees that a complete and correct delivery address is provided. If the customer has not provided a complete and correct delivery address and this results in additional delivery costs, these costs will be borne by the customer.
(3) Upon receiving a delivery with visible external transport damage, the customer agrees to note the damage on the delivery documents (e.g., delivery note, delivery slip, delivery certificate) and have it confirmed in writing by the delivery person or driver.
(4) If damage is not visible externally upon delivery, the customer agrees to immediately report the damage to us so that a claim can be filed with the delivery service.
6. Cancellation Terms
(1) The right of withdrawal is exclusively for consumers. You have the right to revoke this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the day on which the customer or a third party designated by them who is not the carrier takes possession of the final goods. To exercise the right of withdrawal, the customer must inform us of their decision to terminate the contract by means of a clear statement by email. For this purpose, the customer may use the withdrawal form, although it is not mandatory. To meet the withdrawal deadline, it is sufficient to send your notice of withdrawal before the expiration of the withdrawal period.
(2) If the consumer cancels this contract, we must refund all payments received from them.
Once your return is received and inspected, we will send you an email to inform you that we have received the returned item. We will also notify you whether your refund is approved or rejected.
Refunds will be processed within 7 working days of receiving the returned item.
For this refund, we use the same payment method that the consumer used for the initial transaction unless expressly agreed otherwise with the consumer.
